I have seen this type of thing happen. At a previous job, we discovered someone had incorporated GPL Open Source code into closed source commercial product code without really comprehending that you cannot do that. The company was oblivious to this. We quietly removed the code. I suspect there is a lot of this out there.
The whole point on companies not knowing what is in their own code also really rings true. At the same job, we had some code that was purchased as part of a deal that bought another small company. From the headers in some C code, it sure looked to me like that company had swiped code from another organization.
